Terms of Service
Effective Date: August 1, 2026
These terms cover both the free Whazzat app and the paid Whazzat AI subscription. The sections most worth reading are 5 (billing and renewal), 6 (how indexing credits work) and 8 (refunds).
1. Who We Are
Whazzat is operated by Chasing the Twist, based in Massachusetts, United States (“we”, “us”). By creating a Whazzat account or subscribing to Whazzat AI, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the service.
You must be at least 13 years old to use Whazzat, and old enough to enter a binding contract in your jurisdiction to subscribe.
2. What Whazzat Is
Whazzat is a viewer and organiser for photos and videos that you already store in Dropbox. We do not host your media. Browsing, tagging, albums, People you have named, and searching by filename, folder or date are free.
Whazzat AI is an optional paid subscription that adds Smart Search (finding photos by what is in them), automatic album suggestions, and automatic grouping of people.
3. Your Account
- You are responsible for your account credentials and for activity under your account.
- You connect your own Dropbox account. Your Dropbox relationship is between you and Dropbox, under their terms; if your Dropbox access ends, most of Whazzat stops working.
- A Whazzat AI subscription attaches to a connected Dropbox account, not to an individual login. Everyone who connects that same Dropbox account shares the subscription and its indexing credits. Do not connect a Dropbox account you do not control or are not authorised to share.
4. Your Content
Your photos, videos, tags, album names and people names remain yours. We claim no ownership.
You grant us only the permission needed to operate the service for you: to read your Dropbox media in order to display it, and — if you subscribe — to process reduced-size copies as described in the Privacy Policy and to write the resulting search index into your own Dropbox. We do not use your content to train AI models, and we do not sell it.
You are responsible for having the right to store and process the content in your Dropbox, and for it being lawful.
5. Subscriptions, Billing and Renewal
- Whazzat AI is offered on a monthly or annual plan. Prices are shown before purchase on our pricing page and at checkout.
- Your subscription renews automatically at the then-current price, monthly or annually to match your plan, until you cancel. Renewal is charged to the payment method on file.
- Payments are processed by Stripe. We never receive or store your card number.
- Applicable sales tax or VAT is calculated at checkout and added to the price shown.
- We may change prices. A change takes effect for you at your next renewal, and we will tell you before it applies. Continuing after that point is acceptance; if you do not accept, cancel before the renewal date.
- If a payment fails, indexing pauses while your card is retried. Search keeps working during that period. If the payment is not resolved, the subscription ends.
6. Indexing Credits
Indexing a photo costs money every time it happens, so it is metered. One credit indexes one photo, once.
- Included allowance. Each plan includes a monthly allowance of indexing. It refreshes each month and does not roll over — unused allowance is lost at the end of the month.
- Purchased credits. You may buy additional credits as one-time packs. Purchased credits do not expire, and they remain on your account even if you cancel your subscription. They become usable again if you resubscribe.
- Order of use. Your monthly allowance is used first; purchased credits are used only after it runs out.
- Running out. When your balance reaches zero, indexing stops. Nothing is deleted, already-indexed photos remain searchable, and the app tells you how many photos are waiting.
- Credits have no cash value, cannot be transferred between accounts, and cannot be exchanged for money.
- Photos are indexed newest first.
7. Cancelling
You can cancel at any time from Settings, which opens the Stripe billing portal — no email or phone call required. Cancellation takes effect at the end of your current paid period; you keep access until then. We do not pro-rate partial periods.
After cancellation, Smart Search and the other AI features switch off. Descriptions already written into your Dropbox stay there, under your control.
8. Refunds
Payments are non-refundable except where the law requires otherwise. This includes the unused remainder of a subscription period and indexing credits, whether used or unused.
The reason is specific rather than arbitrary: an indexing credit is converted directly into processing we have already paid third parties to perform, and that cost cannot be recovered once incurred.
We may still issue a refund at our discretion — for example for an entirely unused credit pack bought in error, or where a technical fault on our side prevented you from using what you paid for. Contact us before disputing a charge with your bank; we would rather fix it directly.
Nothing here limits rights you have under mandatory consumer law in your jurisdiction.
9. Acceptable Use
Do not use Whazzat to:
- Attempt to access another user's account or data, or to circumvent entitlement, credit or rate limits;
- Resell the service, or use it to build a competing product;
- Automate access in a way that degrades the service for others.
We may suspend or terminate an account that breaches these terms. Where the breach is not serious we will contact you first.
10. AI Features Are Imperfect
Smart Search, album suggestions and people grouping are produced by automated systems and will sometimes be wrong. Descriptions may misidentify what is in a photo; suggestions may be irrelevant; faces may be grouped incorrectly.
They are conveniences for finding your own photos. Do not rely on them for any purpose where an error would matter, and do not treat an AI-generated description as a statement of fact about a person or event. AI features never change or delete your photos, and never apply a tag without you confirming it.
11. Availability and Changes
We aim to keep Whazzat available but do not guarantee uninterrupted service. The service depends on third parties — Dropbox, Stripe and our AI and hosting providers — and their outages will affect it.
We may add, change or remove features. If we discontinue Whazzat AI entirely, we will give reasonable notice and refund the unused portion of any prepaid subscription period, plus unused purchased credits.
12. Disclaimers
The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
Whazzat is not a backup service. Your photos live in Dropbox and are your responsibility to back up. We are not liable for loss of media stored with Dropbox or any other third party.
13. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits or lost goodwill.
Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or twenty-five US dollars.
Some jurisdictions do not allow these limits, in which case they apply to the maximum extent permitted.
14. Governing Law
These terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Massachusetts, and you and we consent to their jurisdiction — except that either of us may bring a claim in small-claims court where eligible.
15. Changes to These Terms
We may update these terms. If a change materially affects your rights, we will give notice before it takes effect — for subscribers, at least before your next renewal. Continuing to use Whazzat after a change takes effect means you accept the updated terms.
